NOTE: PURSUANT TO CONNECTICUT PUBLIC ACT 23-131, AS OF JULY 1, 2023, NO FEE IS REQUIRED WITH THE FILING OF A CLAIM. 

The legal concept of sovereign immunity provides that the state cannot be sued for monetary damages. Unless the legislature consents, the state cannot be held liable for any damage or injury it causes, or for the cost of any goods, services or benefits received by the state. The Connecticut Constitution states, “Claims against the state shall be resolved in such manner as may be provided by law.” 

 

Pursuant to that constitutional provision, the legislature established a procedure for resolution of claims against the state in General Statutes sections 4-141 through 4-165c and in section 54-102uu.   

 

The Office of the Claims Commissioner operates within the Department of Administrative Services for administrative purposes only, with independent decision-making authority
